MIAMI - The deputy press secretary for the Department of Homeland Security was arrested Tuesday for using the Internet to seduce what he thought was a teenage girl, authorities said.

Brian J. Doyle, 55, of Silver Spring, Md., was arrested on charges of use of a computer to seduce a child and transmission of harmful material to a minor. The charges were issued out of Polk County, Fla.

Doyle had a sexually explicit conversation with what he believed was a 14-year-old girl whose profile he saw on the Internet on March 14, the Polk County Sheriff’s Office said in a statement.

The girl was an undercover Polk County Sheriff’s Computer Crimes detective, the sheriff’s office said.

Doyle sent the girl pornographic movie clips and had sexually explicit conversations via the Internet, the statement said.

During other online conversations, Doyle revealed his name, that he worked for the U.S. Department of Homeland Security and offered his office and government issued cell phone numbers, the sheriff’s office said.

Doyle also sent photos of himself to the girl, but authorities said they were not sexually explicit.

On several occasions, Doyle instructed her to perform a sexual act while thinking of him and described explicit activities he wanted to have with her, investigators said.

Homeland Security press secretary Russ Knocke in Washington said he could not comment on the details of the investigation. “We take these allegations very seriously, and we will cooperate fully with the ongoing investigation,” Knocke said.

Doyle was expected to be placed on administrative leave Wednesday morning.

Light plea bargains in assault case stir anger

Two men, including the 18-year-old son of Arizona's Senate president, pleaded guilty Monday to one count of aggravated assault for shoving broomsticks and flashlights up the rectums of 18 young boys last year.

Clifton Bennett, of Prescott, and Kyle Wheeler, 19, of Glendale, accepted a deal offered by the Yavapai County Attorney's Office to drop all but one of 36 original charges in exchange for the guilty plea.

Wheeler also pleaded guilty to an additional aggravated assault charge for choking three of the boys until they passed out.

Parents of the victims expressed frustration and anger over the plea deal, saying it was too lenient.

Judge Thomas O'Toole of Maricopa County Superior Court, who is overseeing the case, said he reviewed evidence and the plea deal fits the circumstances of the case.

The deal leaves the defendants facing up to two years in prison on each count. O'Toole could also reduce the charges to misdemeanors when he sentences the two in May.

"I don't agree with the plea agreement," the mother of one young victim said after the court hearing. "It minimizes the fact that there is more than one victim."

Plea deals called lenient

At the very least, parents wanted Bennett and Wheeler to face one assault charge for each victim.

Many also said they wanted the two men, who were counselors at a Prescott youth camp when the incidents occurred, to face sexual assault charges.

"My client certainly felt like he was being sexually degraded," Texas lawyer Stephen Carrigan said about one of the boys. "He was humiliated."

Lawyers for the defendants would not comment on the case.

Parents, whom The Arizona Republic is not naming to prevent identification of the child victims, say their sons are suffering the symptoms of a sexual assault.

Yavapai County prosecutor James Landis said his office never considered the "broomings" as sexual in nature. Rather, he described what happened as a form of punishment or discipline.

He has said his office could not prove Bennett and Wheeler had any sexual intent.

He said the case likely would have been treated differently if the victims were girls or if there was evidence that the defendants were homosexual.

The Yavapai County prosecutor's position has resulted in letters, phone calls and e-mails to county and state officials, some expressing anger, others calling for an investigation into why the plea deals weren't tougher.

"We have received many calls and letters," Arizona Attorney General's Office spokesman Steve Wilson said Monday. "We have no legal jurisdiction to get involved as things now stand."

Expert weighs in

An e-mail to the Yavapai County Attorney's Office Monday criticized the prosecution.

"As a lawyer in practice for more than 25 years, I was astounded and appalled by . . . Yavapai County's handling of the horrific acts perpetrated by Mr. Bennett and Mr. Wheeler," Phoenix lawyer Carol Cure wrote.

"Reducing these charges to a misdemeanor and/or not requiring serious jail time would be a gross injustice and would certainly send a message that it's not what you do, but who you know."

Legal experts, child advocates and sex-crimes prosecutors say the law doesn't require proof of intent beyond the act itself.

They also say sexual orientation is not a factor in a sexual assault.

"You can't possibly take the position that the insertion of a foreign object into someone's rectum isn't sexual assault," said New York lawyer and bestselling author Andrew Vachss, who specializes in child-abuse cases.

Form of punishment

In June, Bennett and Wheeler were camp counselors at the Arizona Association of Junior High Student Council at Chapel Rock Camp in Prescott. From the outset, they told the 11- to 14-year-old campers they supervised that they would be "broomed" if they violated rules. Boys were told that if they complained, they would be severely punished and if they resisted they would be held down.

Brooms, flashlights and a cane were shoved into the rectums of the boys while they were wearing clothes or swimsuits for various infractions.

Bennett is the son of state Senate President Ken Bennett, a Republican and a Prescott native and businessman.

"I know all of the campers were broomed at least once," Clifton Bennett said in court Monday.

"I know I personally broomed a number of the campers. I know I personally restrained a number of the campers. I now know this was an assault under the law."

1) How can you convict someone for committing a crime against noone.

WASHINGTON (CNN) -- A Department of Homeland Security spokesman charged with soliciting a minor over the Internet was disciplined in a previous job after an incident in which pornographic images were seen on an office computer, his friends and former co-workers said.

Brian Doyle resigned from his Homeland Security Department post Friday, his 56th birthday.

Doyle remains in a Maryland detention center where he awaits extradition to Polk County, Florida. There he is charged with seven counts of solicitation of a minor and 16 counts of transmitting pornographic material to a minor. An extradition hearing is scheduled for May 4. Friends and former co-workers say Doyle was disciplined by Time magazine after he allegedly used company computers to view adult pornography in the publication's Washington bureau office.

Time magazine and CNN are both owned by Time Warner.

Time began an investigation after an employee in the bureau complained after finding offensive photographs on her computer, sources said. The photos, which were not of juveniles, were traced to Doyle. The complaint was dropped after Doyle's colleagues signed a petition of support, the sources said.

Doyle received a formal warning and was required to undergo mental health counseling before returning to work, the sources said.

Sources disagree over whether Time suspended Doyle or whether he took a leave of absence after the incident.

Time magazine said only that it employed Doyle for 26 years and refused to comment further.

Doyle left Time in 2001 and went to the Transportation Security Administration before becoming deputy press secretary at the Department of Homeland Security.

The Time revelation has prompted the chairman of the House Homeland Security Committee to schedule a May 18 hearing to scrutinize Homeland Security hiring practices, security clearances and other personnel issues.

Rep. Peter King, R-New York, said Doyle had access to sensitive information and could have left himself open to being blackmailed by terrorists, foreign governments or organized crime.

Homeland Security's failure to uncover the Time incident shows "serious deficiencies in the background clearance process at the Department of Homeland Security," King said.

Doyle has been "very, very depressed" after the deaths of his parents and two siblings, said his attorney Barry Hefland, who added that wants Doyle to undergo a psychiatric examination.

Police say that on March 12 Doyle had sexually explicit online conversations with and sent pornographic movie clips to a Polk County computer crimes detective posing as a 14-year-old girl. (Watch how youngsters make cash with webcams -- 2:49)

Doyle told the detective his name, his job and his phone numbers, including the one for his government-issued cell phone.

After his arrest Tuesday, Doyle was placed on administrative leave without pay and his security clearance was suspended.
