That said, I would say that congressman should be reprimanded, at the very LEAST.

He IS guilty of assault. Turn the tables. If the young man had assaulted the Contressman, he would have been drug off to the slammer immediately.

In this case, Mister FUCKING ASSHOLE CONGRESSMAN will probably get away with it.

I would't say so unless there is more to it than they're showing you (or it hit the cutting room floor, you can see it's cut at least once) If they have the tape in it's entirety and hand it over top the cops, that congressman's ASS is in the ringer.

That being said, would you call it 'assault'? Looked to me like he knocked the camera out of the way pushed the student, and grabbed his arm. Totally unacceptable for a poltician - I'm not defending him - but would I class that as 'assault'? Not so sure. Maybe I'm just splitting hairs.

Actually "assault" and "battery" are two different charges. "Assault" is the threat of physical harm. "Battery" is doing it. As far as I know, it doesn't take much, even a shove is enough.

Nope. Assault is merely the threat of bodily harm; battery requires that there actually be physical contact. The laws differ from state to state but all that is generally required is "unwanted or offensive physical contact" or something similar. In this case, there was actual physical contact so it is arguably both assault and battery.

I agree that this was probably a staged event, and we probably don't know the full story, but that doesn't really matter.

The guy did seem to jump the gun / go overboard a bit. But holy hell, if I were in the public eye (politician, musician, actor) I could totally see how someone would snap when approached. It's not even like people walk up & politely ask a question or for a handshake/autograph. It's BAM! camera in your face, in front of your path as you walk so as to obstruct you, block the doorway, get in front of the car. I'd be cracking some skulls.
