I'd agree with that. The only thing that gets me is don't they need license to use someones name & likeness? I mean if EVH can go apeshit over red & black striping, you'd think Obama could make a case for some using his name & face.

If you are a private citizen you are more protected by the libel and slander laws than a public figure. Politicians are public figures so they are less protected. That's just the way it is. Regarding EVH, if it's trademarked by him, he can sue your ass off but because he is a celebrity, you probably could print some slanderous stuff on him and he couldn't do a thing.
