HAMPTON, Va. (WAVY) - Tables turned during an attempted robbery in Hampton early Friday morning when a clerk successfully defended himself against a man wielding a tire iron as a weapon.
Jason Price with the Hampton Police Division says they received a tip about a suspicious person in the 300 block of East Pembroke Avenue shortly after 3 a.m. Aug. 31. Police found an injured Ernest Sebastian Simoens, Jr. alleging he had been assaulted. The 21-year-old from New York was transported to a hospital.

Price says police received a call about a robbery that had occurred shortly before 3 a.m. at a 7-Eleven in the 300 block of East Mercury Boulevard. Price says the suspect had entered the store with his face covered with a bandana, brandishing a tire iron as a weapon, demanding money and attempting to assault the clerk, a 25-year-old Hampton man.
Price says the clerk was able to defend himself by disarming the suspect who then fled on foot without obtaining any money or items from the store.
Price says upon further investigation, police found out Simoens was the suspect in the attempted robbery and had been found by police minutes after the incident on East Pembroke Avenue.
Simoens was charged with one count each of attempted robbery, one count of attempted maiming and one count of wearing a mask in public.
Price says charges will not be filed against the clerk at this time because he justified in defending himself.
