WASHINGTON -- The Defense of Marriage Act, the law barring the federal government from recognizing same-sex marriages legalized by the states, is unconstitutional, the Supreme Court ruled Wednesday by a 5-4 vote.

"The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and to injure those whom the State, by its marriage laws, sought to protect in personhood and dignity,” Justice Anthony Kennedy wrote in the majority opinion. “By seeking to displace this protection and treating those persons as living in marriages less respected than others, the federal statute is in violation of the Fifth Amendment.”

Justice Kennedy delivered the court’s opinion, and was joined by Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan. Chief Justice John Roberts and Justices Antonin Scalia and Samuel Alito all filed dissenting opinions.

DOMA, signed by President Bill Clinton in 1996, prevents same-sex couples whose marriages are recognized by their home state from receiving the hundreds of benefits available to other married couples under federal law. During the Obama administration, the Justice Department initially defended DOMA in court despite the administration’s desire to repeal it. But the Justice Department changed course in early 2011, finding that the law was unconstitutional and declining to defend it any longer. House Republicans have since spent hundreds of thousands of dollars taking over that defense.

Plaintiff Edie Windsor, 84, sued the federal government after the Internal Revenue Service denied her refund request for the $363,000 in federal estate taxes she paid after her spouse, Thea Spyer, died in 2009.

During the March oral arguments in United States v. Windsor, a majority of the court seemed to express doubts about the constitutionality of DOMA. Justice Ruth Bader Ginsburg said that supporters of the law seemed to want "two types of marriage," likening same-sex unions to the "skim milk" version of marriage.

I believe that marriage should not have ANY government or authority involved. No changes in tax codes, or anything else that changes when you get married. It should be a spiritual thing between the 2 people and whatever they believe in. It's simply a way to show a promise to love each other forever. The only marriage we should each individually care about is our own. As for anyone else we should be happy that two people found love & happiness. Why we gotta be up in everyones business all the fucking time? For fucks sake already. Tired of this fight.

Our Supreme Court just opened the door to more of the same. Could it be possible that one day marriage as an institution could be outlawed altogether? I believe that is part of Satan’s end-time strategy.

Paul hints at this in a prophetic letter to his spiritual son, Timothy, more than 2,000 years ago. Paul wrote, “Now the Spirit expressly says that in latter times some will depart from the faith, giving heed to deceiving spirits and doctrines of demons, speaking lies in hypocrisy, having their own conscience seared with a hot iron, forbidding to marry” (1 Tim. 4:1-3).

We are in the latter times. We are in the end times even now. And many are indeed departing from the faith. And the Pew Research Center’s Forum on Religion & Public Life reports that half of former Protestants who left the church said they turned away from their childhood faith because they stopped believing in its teachings—and about 40 percent said they did so because they do not believe in God.

Today’s rulings set into motion a dynamic that could mainstream gay marriage in this nation sooner than later—and forward the satanic agenda to eventually end a godly institution that’s almost as old as the world itself.

It's unfortunate how easily people are emotionally manipulated. Gay marriage, immigration, abortion are used to rile people up, divide the people and pit them against each other. I tend to agree with ELVIS that there's something terrible going on though I disagree that the government is the one conspiring to make it happen. I generally think that the wealthy, politically motivated people have already paid for the government, or enough of it to get their way.

They dismantle education, leaving the populace dumber (think about how many creationists there are out there).
They saddle the citizenry with their debt through the Fed
They push the country into further debt through pointless wars for their own personal enrichment
They control public opinion through corporate owned media
They try to strip people's rights to limit the voting population to those most likely to vote for their agenda
They forcefully disband peaceful protest and assembly (OWS)

People don't care. I don't care. It's all pointless, all theatrics. It won't change by voting. It won't change by getting involved. The deck is way too stacked. I genuinely think that eventually financial ruin will settle in, when the next economic collapse happens and they can't print their way out of it. When the dust settles, and people realize how screwed they are, how manipulated they are, how controlled they've been, I think change will finally come.

Until then... it's hard to really care too much about it.

On Friday, September 20, prior to signing the Defense of Marriage Act, President Clinton released the following statement:

Throughout my life I have strenuously opposed discrimination of any kind, including discrimination against gay and lesbian Americans. I am signing into law H.R. 3396, a bill relating to same-gender marriage, but it is important to note what this legislation does and does not do.

I have long opposed governmental recognition of same-gender marriages and this legislation is consistent with that position. The Act confirms the right of each state to determine its own policy with respect to same gender marriage and clarifies for purposes of federal law the operative meaning of the terms "marriage" and "spouse".

This legislation does not reach beyond those two provisions. It has no effect on any current federal, state or local anti-discrimination law and does not constrain the right of Congress or any state or locality to enact anti-discrimination laws. I therefore would take this opportunity to urge Congress to pass the Employment Non-Discrimination Act, an act which would extend employment discrimination protections to gays and lesbians in the workplace. This year the Senate considered this legislation contemporaneously with the Act I sign today and failed to pass it by a single vote. I hope that in its next Session Congress will pass it expeditiously.

I also want to make clear to all that the enactment of this legislation should not, despite the fierce and at times divisive rhetoric surrounding it, be understood to provide an excuse for discrimination, violence or intimidation against any person on the basis of sexual orientation. Discrimination, violence and intimidation for that reason, as well as others, violate the principle of equal protection under the law and have no place in American society.
