UPDATE: St. Louis County law enforcement agencies received twelve 5.56 millimeter rifles and six .45 caliber pistols from the Department of Defense between Aug. 2, 2010, and Feb. 13, 2013, a Missouri public safety official confirmed Thursday. Ferguson, Mo., is within St. Louis County. The Pentagon allows information on "tactical" equipment to be released only at a county level, so which police department(s) in the county received the weaponry is not available.

The Pentagon might not have boots on the ground in Ferguson, Mo., where 18-year-old Michael Brown was shot by police on Saturday, but it does have wheels on the street.

Michelle McCaskill, media relations chief at the Defense Logistics Agency, confirms that the Ferguson Police Department is part of a federal program called 1033 that distributes hundreds of millions of dollars of surplus military equipment to civilian police forces across the United States. The materials range from small items, such as pistols and automatic rifles, to heavy armored vehicles such as the MRAPs used in Afghanistan and Iraq.

"In 2013 alone, $449,309,003.71 worth of property was transferred to law enforcement," the agency's website states.

According to McCaskill, the most recent transfer of military equipment from the Department of Defense to small Ferguson was in November and included two vehicles as well as a trailer and a generator. Details on the vehicles and their intended uses have not been released by the Pentagon. Information on any prior transfers is also unavailable.

A state public safety official told USA TODAY that the Pentagon does not allow detailed information on "tactical" equipment to be released at a police force level, only at a county level. According to a document provided by the official, police forces in the same county as Ferguson received advanced rifle sights and night vision equipment between 2012 and 2014.

There is no evidence that any such equipment has yet been used in the Brown case and its aftermath. But such "police militarization" is just one element of an often toxic relationship between minority communities and local police.

Since the creation of the 1033 program by Congress in the early 1990s, the program has distributed $4.3 billion of excess equipment, ranging from innocuous office supplies to bomb-disposing robots and other advanced technology. The flood of military supplies — along with the continuing drug war and grant programs from other federal agencies that provide military-style equipment — has pushed the culture of police forces far from its law-enforcement roots.

Indeed, the motto of the 1033 program is "From Warfighter to Crimefighter."

So it is not a surprise that police officers often seem prepared for war. In Ferguson, that change is most dramatically revealed in the images of camouflage-wearing police officers with assault rifles, body armor and multiple extra magazines facing unarmed protesters with their hands preemptively raised in the air.

The disturbing trend of police militarization permits law enforcement agencies to view people in their communities as threats, rather than as citizens with rights, reports TheWashington Post's Radley Balko, who has covered the militarization of the police extensively.

Elsewhere in Missouri, agencies participating in the 1033 program have acquired "aircraft (both fixed wing and rotary) and four-wheel drive vehicles (such as pickup trucks, blazers, ambulances and armored personnel carriers)," according to the state's Department of Public Safety.

If there's one thing a community in turmoil does not need is for anyone to turn up the heat as protesters and police face off and tempers simmer. But before a local police officer fired his first shot at the unarmed teen, the U.S. military helped make sure there was plenty of fuel to bring things to a boil.

Here's my take on police officers. I have known a few over the years and have some in my own family. Show the badge a little respect. It's a hard job where they deal with assholes all day long and it's dangerous. More dangerous today than a few decades ago. Treat them with some respect and don't be a problem and usually you get the same back. If I get pulled over I aways keep both hands up on the steering wheel where the officer can see them. Traffic stops are scary and if they can see your hands then they are less tense.

You elect your county sheriff. The chief of police works for your elected mayor. The police work for the citizens and if there is problems with the police well then at the end of the day it's up to the citizens to fix it. It's your city and country and never forget that!

Since 2006, the Pentagon has distributed 432 mine-resistant armored vehicles to local police departments. It has also doled out more than 400 other armored vehicles, 500 aircraft, and 93,000 machine guns.


As The New York Times reported in June, the Defense Department has been making use of unused military equipment by giving it to local precincts.

This is despite the fact that violent crime in the U.S. has steadily plummeted since 1993. Between 1993 and 2012, the violent-crime rate dropped by nearly 50 percent.

Yet today, local police—in cities and small towns across the country—are increasingly loaded for bear. How did this militarization of the police force come about? It all seems to have started with an obscure section in a defense bill passed more than 20 years ago.


In 1990, Congress passed a National Defense Authorization Act with a clause allowing the "transfer of excess personal property" from the Defense Department to local law enforcement—otherwise known as Section 1208. The clause was included in response to the surge of violent crime and the War on Drugs in the late 1980s. (It's worth noting that at the time, both chambers of Congress were controlled by Democrats.)

Here's the full language of the Section 1208:

SEC 1208. TRANSFER OF EXCESS PERSONAL PROPERTY

(a) TRANSFER AUTHORIZED.—

(1) Notwithstanding any other provision of law and subject to subsection (b), the Secretary of Defense may transfer to Federal and State agencies personal property of the Department of Defense, including small arms and ammunition, that the Secretary determines is—

(A) suitable for use by such agencies in counter-drug activities; and

(B) excess to the needs of the Department of Defense.

(2) Personal property transferred under this section may be transferred without cost to the recipient agency.

(3) The Secretary shall carry out this section in consultation with the Attorney General and the Director of National Drug Control Policy.

(b) CONDITIONS FOR TRANSFER.—The Secretary may transfer personal property under this section only if—

(1) the property is drawn from existing stocks of the Department of Defense; and

(2) the transfer is made without the expenditure of any funds available to the Department of Defense for the procurement of defense equipment.

(c) APPLICATION.—The authority of the Secretary to transfer personal property under this section shall expire on September 30, 1992.

The transfer program does not foist armored vehicles upon local precincts—as The Times explains, "the pace of transfers depends on how much unneeded equipment the military has, and how much the police request." And for local police departments with tight budgets, the free gear can be a welcome windfall. But it can also mean a disproportionately armored police force in a town of, say, 21,000.

The Pentagon's transfer program may have been a direct outgrowth of the War on Drugs, but as Alec MacGillis wrote in The New Republic on Thursday, it's not the only cause of heightened police militarization. The terrorist attacks of 9/11 led to a heightened state of security in the U.S., and that has trickled down to local law enforcement.

On a national level, the current Congress may be expected to reverse the actions of 1990. On Thursday, Sen. Rand Paul wrote a column in Time chastising the use of excessive force in Ferguson. "There is a legitimate role for the police to keep the peace, but there should be a difference between a police response and a military response," he wrote. "The images and scenes we continue to see in Ferguson resemble war more than traditional police action."

"Together, we should all mourn the loss of life in Ferguson, Missouri and work to keep our communities safe and free," Sen. Ted Cruz wrote in a Facebook post. "Police officers risk their lives every day to keep us safe, and any time a young man loses his life in a confrontation with law enforcement, it is tragic."

We still don't know all the details of what happened Sunday night between a Ferguson police officer and 18-year-old Michael Brown. What we do know is that the police response has made the safety of its own forces a No. 1 priority.

Back in June, a Missouri police captain told The Times that civilians should be fine with police militarization, so long as it means their public servants are being kept safe. "When you explain that you're preparing for something that may never happen, they get it," the captain, Tiger Parsons, said at the time.

But as tear-gas canisters and rubber bullets rain down on Ferguson's residents, they may be less than understanding about the excess of caution the police are using to protect their own.

Went to the Soviet Union in 1978 with my parents and my dad's cousin. A Russian history professor from Utah State University put the trip together. We got on a train in Helsinki, Finland and rode over the border to Leningrad. Spent a few days in Leningrad and flew Aeroflot to Moscow. Ball point pens, Wrigley's gum, and Levis were hot items. I traded gum for Soviet medals. I still have them. The consumer goods available were pretty sparse and you had to stand in several lines to buy anything. It took a while to figure their system out which was a pain in the ass.

They did have these odd soda pop machines on the streets. There were glasses on top of the machine. You grabbed one and the machine filled it up. There was one flavor. Orange. When you were done drinking your soda pop there was a little dishwasher you washed the glass in and you set it back on top for the next person to use. The one good thing they did have over there was their ice cream. They knew how to make good ice cream and they had this machine that would push the ice cream out like an extrusion machine and then they would cut off how much you wanted. So instead of how many scoops it was how long.

When we went to China in 1980 there were three things to drink. Tea, beer, and orange soda pop. The orange soda pop in China tasted the same as the pop I had in the Soviet Union. Communists were into that orange soda pop I guess. I laughed. I was in Fred Meyer buying some Jones soda pop and they had commie orange pop in a bottle with Lenin and the hammer and sickle on it. The KISS trib thing was really fun. Call it a mid life crisis band. Could have bought a Ferrari but stayed with guitars and that's over now.
