That's kinda old but it does take intelectual property to a new level... If I recall most of the VH related web site owners were contacted and provided terms for continued use of the copyrighted items... most opted to remove the stuff rather comply with the terms.
Branding and copyrighted trademarks etc... hold a lot of earning potential for the owner. I can see protecting things like the IBM logo, Chevy's bowtie, fender's headstock design, etc... to protect against fraudulent products and such but banning red/black/white striped images on a fan site for a rock band seems a bit over the top.

it's not that bad, ZZ. basically, it was saying that the fan sites could use the designs so long as they acknowledged on their sites they were using copyrighted property and so long as they weren't using the site to profit from the sale of goods or services.
the license specifically states that the fan sites can't use the designs in an obscene matter, but the sites CAN be critical of van halen and still hold the license.
and of course, if the sites want to be obscene, but keep the trademarked designs from being obscene, they're ok.
personally, i think this wasn't too bad of ed. it was a way to make sure he preserved his right to the designs, while still letting the fan sites use them for free.

Yeah, this news is at least a couple years old. I remember Brett had to change his site a bit because of it. And yeah, lot's of uproar about it at the time. Ed's got the absolutely worst PR guy in the history of PR guys in my opinion. Oh, Eddie does his own PR you say? That figures...

I think Brent's dad told him to back off but to me it makes no sense.
The worst case scenario would have been a court action that would have validated his site and got tons of publicity/hits which he could have retreated from when push came to shove.
I've told him as much but we have to agree to differ.
THen again we are talking about a site that is predominanly pro Van Hagar funded at great expense by a guy who prefers Roth music but bans anyone that agrees with him!!???
I think Brent either wants to run an official site to meet EVH or get's a kick from lording it over people.

Agreed it wasn't too bad but the clause on obscene left it pretty open to subjective interpretation, which also meant you had to inflict certain rules of behavior to adhere. That would have meant simular managing of the site like the way the Dome was handled... which wasn't very popular among portions of the community at large. i don't think so. here's the statement:
i would think this means not using the licensed product in an offensive manner, i.e.: having pictures of frankenstrat-ed naked men, etc...Licensee does not use the Licensed Properties in any manner which Licensor would consider to be very offensive
but it's pretty explicit in the following sentence that:
so if you have a message board that yells shit about van halen, you're fine.This Section 2.6 does not prevent Licensee from making or posting critical comments about VAN HALEN and/or its members on the Fan Site, subject to applicable law;
the real problem was if you sold unlicensed van halen goods, OR had a link to a site that did that on your site, then you couldn't use the frankenstrat-ed design or the =VH= logo. i'm pretty sure THIS is the reason that most sites who stopped using the copyrighted material did so.

Well first of all, it was 2 years ago guys, this is very old news.
I changed from the stripes because I wouldn't agree to anything that would be legally-binding, and if that's the kind of BS Ed wants to do, I didn't want any part of it. I wanted to be able to say and post what I want to on my site, I didn't need the long-arm of Eddie Van Halen's legal team watching my every move. I get emails from them as it is about shit people say. Whether what he's doing is 100% legal or not is not something I give a shit enough about to fight. Who the hell has time for that nonsense.
I have no desire or interest in "going to court" over stupid stripes on a web site. Sesh seems to think it would be great publicity? To who? Who the fuck cares about a stupid Van Halen site? Nobody.
And I wouldn't be VH's official webmaster if they begged me, I have absolutely no interest in that at all. I like being able to say what I want, to post where I want freely, without having to watch my every word, and run a web site the way I want. The same thing Sarge likes to do here. I don't know why anyone would want to run an official site actually, so much bullshit and red-tape, who needs it. I've met the band, I've held Mike's bass before. That's more than enough for me.
And I've continued to have the swirl logo on there, so I guess I'm being a real rebel. :roll:
