As far as who gets what kind of punishment it's up to the judge.
And if you think the cops don't keep a record of everything you've ever even been accused of doing and the judge doesn't have access to that info you must live on fantasy island.

When I was busted (1989) there was no medical marijauna laws .
And yeah I punched acop .
An undercover cop that I thought was some dirtbag pulling a gun on my friend .
I didn't know he was a cop until his partner yelled out "sherrifs department".
I put up my hands and told him I thought he was a armed robber.
They chose not to prosecute because the first cop admitted he had not yet identified himself before I hit him.
But all that judge saw was I hit a cop and got away with it.
Considering his mindset I wasn't taking any chance of taking the fall for the 5 pounds my roommate was caught with.
And it is rare anymore that you wouldn't get at least a ticket if you even had one joint.
They used to just look the other way but it's not like that around here anymore.
