    No charges will be filed against homeowner who shot, killed intruder



    BAKERSFIELD - A home owner will not face charges after police say the home owner shot and killed a man trying to enter his home.

    On March 24, Shawn Christian Ibarra, 35, armed himself with a breaker bar and was trying to force his way into a residence at 4100 block of Christmas Tree Lane. He kicked in the front door and was shot by another man in the house. Ibarra died as a result of his injuries.

    The BPD said that Ibarra was on Post Release Community Supervision, commonly known as AB109.

    The District Attorney's office said they will not press charges against the homeowner.

      Police say members of a Winter Haven, Fla., family acted in self defense when they shot and killed a home intruder early Monday.

      Mitchell Large, 40, allegedly entered the family's home through the back door at about 7 a.m. He ignored a warning shot fired at the door, Police Chief Gary Hester told Fox Tampa Bay.

      Police said family members armed themselves. More than one shot was fired at the intruder as he made his way into the kitchen. The homeowner's 20-year-old daughter was also at home at the time, but not involved in the shooting.

      Large appears to have been unarmed, but Hester said the family was within their rights.

      "It's not a very far reach to assume that if someone's forcing their way into your residence early in the morning, they're not there to wish you well," Hester told Fox Tampa Bay. "When he failed to retreat, they certainly... would have a right to defend themselves."

      The Orlando Sentinel reports that homeowner Luis Pena fired the shot that killed Large. The suspect was dead inside the home when police arrived. It's unclear if other family members fired their weapons. An autopsy is being conducted by the medical examiner's office.

                      • EAST POINT, Ga. —

                        A woman shot an intruder when he tried to force his way into her apartment early Thursday morning.

                        Police say at least three people approached the victim's door at the Laurel Ridge apartment complex just after midnight.

                        According to the police report, the renter responded to a knock at the door and the suspects told her they were with the East Point Police Department.

                        She cracked the door to take a look outside and that's when police say the three tried to push their way inside.

                        The resident, however, was ready with a handgun.

                        She spoke briefly with Channel 2's Carl Willis, telling him she's still shaken up and didn't want to be identified.

                        "It could be retaliation," she explained.

                        Police say one of the suspects raised a handgun, but the woman fired first.

                        "I heard three gunshots," said neighbor Ramona Ferrell. "I knew it was gunshots. It was very close."

                        A juvenile suspect was grazed on the head and the backside. He ran, but police caught up to him quickly.

                        "I just hope the boy is OK," said the resident.

                        The two other men got away.

                        Neighbors say there has been a rash of break-ins recently. They said days earlier someone tried to break into an apartment in the same building where the shooting happened.

                        "I think it's ridiculous," said Ferrell. “Something should be done. There's a lot going on in this apartment complex."

                        Neighbors say they are glad that the victim didn't back down and wasn't hurt, but they say the crime has to stop.

                        "I'm glad she did have something," said Ferrell. "It's sad that you have to walk around as a female with a gun to protect yourself."
