A federal judge denied an emergency request from President Donald Trump’s campaign to stop ballot counting by the Philadelphia County Board of Elections until Republican observers are present.
The campaign sought an injunction on Thursday afternoon, claiming the board is “intentionally violating” state law by not allowing poll watchers from the Trump campaign and the Republican party to monitor the counting of mail-in and absentee ballots.
U.S. District Judge Paul S. Diamond issued a one-sentence order after a hearing, saying he was denying the order “in light of the parties’ agreement.”
Diamond suggested that each party be allowed 60 observers inside the convention center where election officials are counting ballots, according to the Associated Press. Diamond scolded the bickering lawyers at the hearing, according to the AP.
“Really, can’t we be responsible adults here and reach an agreement?” Diamond said, according to the AP. “The whole thing could (soon) be moot.”
After the ruling, the city commissioners said that Trump and his campaign “falsely claimed throughout the day that their representatives were not allowed in the room.”
During the hearing, a lawyer for the campaign admitted that “they had several representatives in the room,” according to a statement by the bipartisan board. In fact, the Republicans had at least 19 observers in the room during the afternoon, according to the statement.
The City Board of Elections also agreed to admit no more than 60 observers per side, according to the statement.
The hearing, held shortly after the Trump campaign filed the lawsuit, came amid a tense battle over the 20 electoral votes in Pennsylvania, where Democratic nominee Joe Biden hopes to overtake the president. Biden needs a win in either Pennsylvania, Georgia, Nevada or North Carolina to secure the White House, assuming other race calls hold up.
Earlier on Thursday, a Pennsylvania state court judge ruled that observers could stand as close as 6 feet (2 meters) away while election officials counted mail-in and absentee ballots. The city petitioned the state Supreme Court to allow it to appeal.
The case is Donald J. Trump for President Inc. v. Philadelphia County Board of Elections, 20-5533, U.S. District Court, Eastern District of Pennsylvania (Philadelphia).

5% of votes to be counted yet.....about 163,000 votes are outstanding, 70-80% of which will be for Biden.
North Carolina is the only state where chumpie is leading, and it is only by 1.4% with 5% of the votes still to be counted.
At present, Biden looks to be able to get over 300 electoral votes. And chump cannot win unless he takes both GA and PA.
Looks like Biden will be projected as new President sometime later today.

It's not looking good for Trump this morning... none of the counts are going in his favor... on to the courts and several more weeks of nonsense.
Unless there's some really significant fraud... there's plenty speculated but nothing factual at this phase, I don't believe there's anything that's enough to overturn the results. Even if the SCOTUS blocks the votes received after the election due to the last minute legal changes in Pennsylvania... Georgia and Nevada still put Biden over 270.
Next up... how smooth or messy will the transfer of power be..?

The battle going forward is going to be in Georgia for a while. Both senate seats are in the runoff on January 5. If Biden was smart, he wouldn't even announce any cabinet appointments until after that date. I'm basing my opinion of Biden's degraded mental capabilities from my own experience dealing directly with my wife's parents who both suffered dementia and progressed into Alzheimer's before passing the last 3 years. Plus dealing with that presently with my own 89 year old mom...

I've just been closely following things, listening to Biden's speeches and press interaction, watching facial expressions and body language. He's slipping a few gears quite frequently and in a fairly consistent manner. The challenge is how fast it may or may not progress... could be years. Westminster Management has moved against largely low- and middle-income tenants in the Baltimore area, many of them Black, whose apartments are managed by the company, according to the Post.
A state moratorium protects tenants against evictions as people struggle with loss of jobs during the pandemic. A federal moratorium for government-supported housing, which includes some run by Westminster, also offers tenant protections during the crisis.
But Westminster, which manages some 20,000 apartments, and other management companies are eager to get started on the process against tenants with past-due rent.
One resident of a Westminster-managed apartment Tashika Booker, told the Post she lost her job working for an online education company because of the pandemic. She said she’s struggling to pay rent as she seeks other work.
Westminster, part of the Kushner family’s Kushner Cos., said in a statement that Westminster’s actions are fully compliant with state and federal eviction bans.
Jared Kushner said he gave up managing Kushner Cos. when his father-in-law, President Donald Trump, made him a senior White House adviser. But he maintained his ownership in the company. He earned $1.69 million from his stake in Westminster last year, according to his financial filings.
Westminster is currently fighting a lawsuit by Maryland Attorney General Brian Frosh, which accuses the company of violations concerning tacked-on fees and poor housing conditions.

Months before the suit was filed, Trump slammed the Baltimore congressional district represented by the late Democratic Rep. Elijah Cummings’ (D-Md.) as a “disgusting, rat and rodent infested mess.”
Kushner properties in the area at the time had racked up hundreds of building code violations. An earlier lawsuit described one Kushner apartment as having a leaking bedroom ceiling, maggots in the living room carpet and raw sewage spewing form the kitchen sink.
As for the suit filed by Frosh, Kushner Cos. managers have denied the charges, and claim the court action is politically motivated.
Kushner last month dismissively blamed Black Americans for their hardships, saying that they must “want to be successful.”

Its kind of weird to think about it that the perception is that Biden has come from behind to win these states when it's the opposite. His votes were early. The Republicans insisted that the votes couldn't be counted until after the election and then Trump said to stop counting!
Voting by mail is a very new thing in most of the states. Fortunately up here in Cascadia, we have been doing it for a while. I've been voting by mail since 1992 myself, long before it became the state standard, because I was moving too damned often in the 1990s to remember where my official polling place was. Now it's my couch, so it's easy to prepare my mind when I have to vote for one of those "lesser evil" types.
If you only have a choice of 2 people it would be fucking weird if you happened to agree and like everything about one of them.
The problem is the system and how difficult it is to change a system when by definition any people elected are not going to want to change it.
The US and UK systems are not fit for purpose. They are shit. They hide behind bullshit that they are the originals or the oldest or the mothers of all the others. That's like saying your old Nokia phone is the best because it was first.
