WTF? Chickenfoot using RWTD melody on new CD?

is it just me, or does that guitar on the sample playing at http://www.chickenfoot.us (right after the intro when the melody starts) sound like a blusey version of RWTD? Get Dave's lawyers on this ASAP!

Anything left in that bottle?
