Under heavy security, Osama bin Laden's son-in-law will appear this morning in a New York federal courtroom to answer to charges of conspiracy to kill U.S. citizens as a top member of al Qaeda's inner circle.

Sulaiman Abu Ghaith, who U.S. officials said has already given up "key intelligence" on al Qaeda since his capture in Turkey, is expected to stand before a federal judge less than a mile from the World Trade Center memorial pools, one of the sites of the Sept. 11, 2001 terror attack that claimed the lives of nearly 3,000 Americans. Shortly after that attack, Abu Ghaith appeared in two videos online -- one alongside Osama bin Laden -- proclaiming, "We carried out what God ordered us to do," and calling on others to join a holy war against America.

Lawmakers and U.S. officials on Thursday revealed Ghaith's capture and secret transfer to New York. After spending years in Iran, Abu Ghaith was taken into custody in Turkey in January and later turned over to Jordianian authorities. From there U.S. officials took over the case and spirited Abu Ghaith to New York City sometime last week.

But even before he arrived on American soil, U.S. officials told ABC News he was "cooperating" with interrogators and providing key information on al Qaeda's status, personnel and finances.

"It is huge," Rep. Michael McCaul (R-Texas), the chairman of the House Homeland Security Committee, said Thursday. "This is a man who is in the inner circle of bin Laden's al Qaeda operations and now we have him alive and he's talking."

The FBI's George Venizelos referred to Abu Ghaith as holding a "key position in al Qaeda, comparable to the consigliere in a mob family or propaganda minister in a totalitarian regime."

"No amount of distance or time will weaken our resolve to bring America's enemies to justice," Attorney General Eric Holder said Thursday. "…[T]his arrest sends an unmistakable message: There is no corner of the world where you can escape from justice because we will do everything in our power to hold you accountable to the fullest extent of the law."

Dr. Thomas Lynch at the National Defense University told ABC News Thursday that beyond providing a potential intelligence windfall, Abu Ghaith's capture meant one of the more dangerous members of core al Qaeda is now out of play.

"Abu Ghaith is one of ten guys left from al Qaeda core that have the financial ties and reputation who might have been able to get the old band back together to execute spectacular international terror attacks," he said.

Everyone should have a fair trial. This business of labeling people as terrorists and using that to justify killing them without due process has to stop. Look at how much our government has abused that excuse. It time to nix that shit.

Um, no. It isn't. I saw it this morning. They did say he was little more than a bit player and pretty much the equivalent of the guy everyone dumps on and the one who has to run the errands...

The U.S. government already claims the power to assassinate, indefinitely detain or torture anyone in Al Qaeda or “associated forces”:

In the name of “fighting Al Qaeda or associated forces” or those who “support” those bad guys, the U.S. government has authorized:

Assassinating people anywhere in the world without due process or even a legal charge . . .
including U.S. citizens

Indefinitely detaining any American – without trial (and see this)
Torturing people . . .
including Americans living on American soil

Labeling virtually any American as a “terrorist“

Now, the government wants to allow targeting of “associates of associates” of Al Qaeda.

As the Washington Post reported yesterday:

A new generation of al-Qaeda offshoots (yeah right) is forcing the Obama administration to examine whether the legal basis for its targeted killing program can be extended to militant groups with little or no connection to the organization responsible for the attacks on Sept. 11, 2001, U.S. officials said.

The Authorization for Use of Military Force, a joint resolution passed by Congress three days after the strikes on the World Trade Center and the Pentagon, has served as the legal foundation for U.S. counterterrorism operations against al-Qaeda over the past decade …that have killed thousands of people.

The authorization law has already been expanded by federal courts beyond its original scope to apply to “associated forces” of al-Qaeda. But officials said legal advisers at the White House, the State Department, the Pentagon and intelligence agencies are now weighing whether the law can be stretched to cover what one former official called “associates of associates.”

Officials said they have not ruled out seeking an updated authorization from Congress or relying on the president’s constitutional powers to protect the country. But they said those are unappealing alternatives.

The debate comes as the administration seeks to turn counterterrorism policies adopted as emergency measures after the 2001 attacks into more permanent procedures that can sustain the campaign against al-Qaeda and its affiliates, as well as other current and future threats.

“You can’t end the war if you keep adding people to the enemy who are not actually part of the original enemy,” said a person who participated in the administration’s deliberations on the issue. [Indeed, endless war is a feature, not a bug, of government policy.]

He said extending the AUMF to groups more loosely tied to al-Qaeda would be “a major interpretive leap” that could eliminate the need for a link between the targeted organization and core al-Qaeda.

Still, the administration has taken recent steps — including building a drone base in the African country of Niger — that have moved the United States closer to being able to launch lethal strikes if regional allies are unable to contain emerging threats.
In other words, the government wants to play Six Degrees of Kevin Bacon with our life and liberty.

I have no problem with him being tried in US federal court. It's probably in bad taste having the trial in New York where the attack happened.

I didn't "condemn" anyone, I can't. He's getting a fair trial in a court of law. WTF would you "see" what he's guilty of on a CNN video or any other video? I recall you having no problem with a fuckwit hunting down that kid in Florida and "condemning" him. It's an interesting double standard of "proof" and justice that you have. You're pissed that the Air Force blasts people with Predator drones, now you're pissed when people are apprehended and given a trial...
