Wow, I'd never seen that footage either. As I recall, the "band" only performed a small handful of shows before being forced off the road. For those unfamiliar with this sordid story, check out the articles at this site: Bogus Deep Purple

It's amazing that these dorks thought they could get away with this.

"Deep Purple" 1980 (from left to right): Dick Juergens (dr.), Tony Flynn (g.), Tom De Rivera (bg.), Geoff Emery (kb.) and Rod Evans (voc.).

Oh yeah. The Rod Evans clone band. What a load of rubbish that was. I downloaded a video of a gig they did in Mexico City. Might be the one above, but I am on dialup and it is not loading.

Anyway, I could not even make it through the entire video, even though it was only like 10 or 12 minutes long. Could not believe how they SUCKED!

Didn't one of the more recent NewShits lineups actually have more members of Black Flag in it (Dez & Robo) than it did original Misfits?

Well, firstly the idiots in question have to give us a reason to think of them as less than worthy of respect. For some of them it is not too difficult. Just watch the loser version of Deep Purple for example, and it is quite easy to refer to them as a bunch of fucking lame jackasses.

After that, it is just a matter of coming up with something to describe the fucking scumbags.

Another good example is van hagar. I refuse to capitalize the first letters of that name, as they sucked fucking ass once they got Spamulus Flatulus The Fat as their fucking lead twinkie-eater.

Is there anything about bands you don't know, chef?

Anyhoo, about two years ago I ran into this guy when I worked near the corrupt State capitol building.

That's "Bozwer" from some defunct 50's do-wop act. So what does he have to do with this thread? Well, turns out Bozwer was in town to lobby for legislation to stop bogus bands from performing under legitimate names. Bozwer's was fighting for the dignity of a lot of bands whose original members either have died, were to debilitated to perform on stage anymore, or couldn't play due to legal reasons. Many of them were being ripped-off by having clones saying they were such-and-such an act and toured freely with little opposition to performing under a band's name that had no original or surviving members in it.

The State Senate ended up passing a law banning all such acts from performing for pay unless there was one original member (immediate family or even distant relatives did not count) in the act or the act itself had permission to perform under their name. Good or bad, Bozwer's law really did kill the bar scene from such carbon-copy acts playing anywhere around here.

As for those fools in Mexico, they should have seen it coming when that dufus kept saying, "Clap your hands together!"

For one, I really, really, no, I really fucking hate it when bands condescend to their audience like that. My response is "Fuck you! First play something worth clapping [our] hands to." and two, when a band tours only to play their "hits" you automatically know they're going to suck.

Can't find the link to his story on fighting for legislation but take my word for it. It's true.

The group was Sha Na Na. You'll have better luck looking under Bowser's full name, which is Jon Bauman. Here is a link to an article about his crusade with video of him testifying, along with a link about the Senate Bill.

It seems ironic to me that a guy that made a living ripping off 50's acts should be the one spearheading the crusade against such things.

I loved watching Sha Na Na as a kid, BTW.

Further irony there... I don't even think Bowzer was an "original member" of Sha Na Na.

At least I don't see him in this performance from Woodstock, and that was several years before their 70's TV show......

Deep Purple being out of commission at the time, were not able to shut down the bogus band for awhile.

Here is the true story of how this crap happened.

Guitarist Tony Flynn and keyboardists Geoff Emery were members of New Steppenwold, a band that had a brief 3-year run, with one original member of the band, keyboardist Goldy McJohn, and a later player with the original band, bassist Nick St. Nicholas. St. Nicholas was the only guy to stay for the entire 3 years. Their promoter was a guy named Steve Green, whose company, Advent Talent Associates, specialized in 'revival acts', bands who had retired or broken up, around which a bunch of hired guns could be drafted and sent out on the road around one or two original or close to original members.

So Tony Flynn and Geoff Emery drafted the current New Steppenwold drummer (as that band wound down) and tracked down Rod Evans, who had gotten a medical degree and was the Director Of Respiratory Therapy at some hospital in California. Rod contacted Nick Simper about the deal, but Nick turned it down immediately.

One thing they overlooked and that was Deep Purple's name was well-protected from a legal standpoint. The name was registered in the UK in 1968, and in 1971 a company was formed called Deep Purple Overseas, Ltd. just to prevent other people from trying to use the name for bullshit stuff like this.

So....Geoff Emery registered the name Deep Purple with both the US Patent & Trademark Office and the State of California, lying to those entities, claiming nobody else had the name.

The William Morris Agency got in on the act, and started booking shows for the con artists. They even signed a recording deal with a label affiliated with Warner Brothers, Deep Purple's original American label.

They went into the studio and recorded half a dozen songs even.

The fuckheads played a few shows in Texas leading up to the Mexico City show.

When the crowd discovered NO familiar faces in the band, they became irate. Then, to top it off, the band played only 40 minutes and then left. No encore.

It caused a riot (deservedly so).

By then, the REAL Deep Purple had found out what was going on, and began to put a stop to it. However, the band was playing gigs in the Midwest and the East Coast, many of which ended (or began) with riots, much damage to the venue, etc.

Their last show was at the Long Beach Arena on August 19th.

A lawsuit had been filed by the members of Deep Purple, and on October 3, 1980 an injunction was issued, awarding the sum of $672,000 to the REAL Deep Purple.

The bogus band broke up immediately.

I got this info from a book I have called "Smoke On The Water - The Deep Purple Story". There were many more details about riots at gigs, at one show the fans showered the stage with chairs when they found out who this supposed "Deep Purple" was (a bunch of fucking nobodies), causing the band to beat a hasty retreat.

It is amazing how fucking stupid people can be sometimes. Rod Evans for sure was a fucking moron for even considering doing such a thing, even though he once was a member.
