Trump lawyers quit documents case, and a former Trump aide is indicted

WASHINGTON (Reuters) -Two lawyers defending Donald Trump on federal charges of illegally retaining classified documents quit the case on Friday and a former aide was charged as well in surprise developments one day after the former U.S. president was indicted.

Trump said on his Truth Social platform that his former military valet, Walt Nauta, had been charged in the case. Nauta went to work at Trump's Mar-a-Lago resort after working in the Trump White House. It was unclear what his charges were.

Nauta's lawyer, Stanley Woodward, declined to comment. A spokesperson for Special Counsel Jack Smith, who is leading the prosecution, could not be reached immediately.

Nauta "served proudly with me in the White House, retired as Senior Chief, and then transitioned into private life as a personal aide," Trump wrote on Truth Social.

In an earlier post, Trump said he would be represented in the case by white collar defense lawyer Todd Blanche, who is representing him in a separate criminal case in Manhattan.

Trump made that announcement after his lawyers John Rowley and Jim Trusty quit the case for reasons that were not immediately clear.

"This morning we tendered our resignations as counsel to President Trump," the two lawyers said in a statement. "It has been an honor to have spent the last year defending him, and we know he will be vindicated."

Trump faces seven criminal counts related to his treatment of sensitive government materials he took with him when he left the White House in January 2021, according to a source familiar with the matter.

He is due to appear in the Florida court on Tuesday, a day before his 77th birthday.

The indictment of a former U.S. president on federal charges is unprecedented in American history and emerges at a time when Trump is the front-runner for the Republican presidential nomination next year.

The case does not prevent Trump from campaigning or taking office if he were to win the November 2024 presidential election. Legal experts say there would be no basis to block his swearing-in even if he were convicted and sent to prison.

Trump charged with 37 counts in classified documents case, indictment says

Trump indictment in classified records case is unsealed

A 37-count criminal indictment against Donald Trump was unsealed Friday, revealing allegations that thr former president willfully retained classified government records and conspired to prevent their return to U.S. officials.

The charging document, which alleges Trump kept records containing national defense information after leaving the White House, was made public a day after the ex-president was indicted by a grand jury in U.S. District Court in Miami.

Among other allegations, the indictment says that Trump showed classified documents to other people in the summer of 2021, after leaving office.

One of those documents was a “plan of attack” that he told a publisher and writer at his Bedminster, New Jersey, golf club was prepared by the Pentagon.

“As president I could have declassified it,” Trump told them, according to an audio recording of that July 2021 comment which is quoted in the indictment.

“Now I can’t, you know, but this is still a secret,” he added.

A month or so later at Bedminster, Trump showed a representative of a political action committed “a classified map related to a military operation” and told the other man “he should not be showing it to the representative and that the representative should not get to close,” the indictment alleges.

Also charged in the indictment was Trump’s valet, Walter Nauta, who faces several of the same charges as his boss, with whom he allegedly conspired to keep classified records and hide them from a federal grand jury.

The indictment said that Trump was personally involved in packing up boxes of documents as he prepared to vacate the White House to his home at his Mar-a-Lago club in Palm Beach, Florida.

The FBI raid of Mar-a-Lago last August discovered hundreds of classified documents, which he had failed to turn over to U.S. officials despite a year or so of efforts to recover them.

The current indictment says, “On December 7, 2021, Nauta found several of Trump’s boxes fallen and their contents spilled onto the floor of the Storage Room [at Mar-a-Lago] including a document marked “SECRET//REL TO USA, FVEY,” which denoted that the information in the document was releasable only to the Five Eyes intelligence alliance consisting of Australia, Canada, New Zealand, the United Kingdom, and the United States.”

Department of Justice special counsel Jack Smith, in a televised statement Friday afternoon, said, “Our laws that protect national defense information are critical to the safety and security of the United States and they must be enforced.”

“Violations of those laws put our country at risk,” said Smith, who led the investigation of Trump in the classified documents case. Smith is continuing to oversee a separate criminal investigation of Trump for his efforts to overturn his loss to President Joe Biden in the 2020 election.

Trump, who is seeking the 2024 Republican presidential nomination, and Nauta are due to be arraigned in Miami on Tuesday, the day before Trump’s 77th birthday.

He and Nauta each face a maximum possible sentence of 20 years in prison if convicted of the most serious charges, which are conspiracy to obstruct justice and counts related to withholding and concealing the government records.

Thirty-one of the counts accuse Trump of willful retention of national defense information. He is also charged with conspiracy to obstruct justice; withholding a document or record; corruptly concealing a document or record; concealing a document in a federal investigation; scheme to conceal; and false statements and representations.

Trump was put under criminal investigation in the spring of 2022, after the FBI was notified that classified documents were found in the 15 boxes of government records he gave to the National Records and Archives Administration after months of effort by NARA to recover documents the agency believed were missing.

By law, presidents must give NARA all government records when they leave office.

The indictment notes, “As he departed the White House, TRUMP caused scores of boxes, many of which contained classified documents, to be transported to The Mar-a-Lago Club in Palm Beach, Florida, where he maintained his residence.”

“TRUMP was not authorized to possess or retain those classified documents,” the indictment says.

Trump later suggested to any attorney that he lie to the FBI and a grand jury by saying that he did not have the documents they were seeking, and directed Nauto to move boxes of documents to conceal them from Trump’s own lawyer, the FBI and the grand jury, the indictment alleges.

Trump also is accused in the indictment of suggesting to his lawyer that the attorney hide or destroy documents, that he gave the FBI and the grand jury only some of the documents he had kept while claiming he was fully cooperating.

And Trump caused a certification to be submitted to the FBI and grand jury, falsely representing that all documents had been produced when he knew that was not true, according to the indictment.

The indictment estimates that Trump’s trial would take between 21 and 60 days.

The DOJ’s indictment includes photos of classified documents found at former President Donald Trump’s Mar-A-Lago residence.

Earlier Friday, two of Trump’s lawyers resigned from representing him in the classified documents case, and in the criminal investigation involving the 2020 election.

Trump was indicted by a New York state grand jury in late March on charges of falsifying business records related to a $130,000 hush money payment his then-lawyer Michael Cohen gave porn star Stormy Daniels shortly before the 2016 election.

Trump has pleaded not guilty in that case, which is set to go to trial next March in Manhattan Supreme Court.

The phrase witch hunt is based on the fact that witches don't factually exist.

It's not a witch hunt if the person did the thing whether you are sad about it or not.

This whole circus has many more acts to follow... anything is possible.

The current DOJ has forced them selves into a legal corner over this escalating battle against Trump... at some point "the rule of equal application of the law" will become unavoidable and the Biden family corruption investigations will be acted on. Things will get worse on both sides...

This isn't a good time for our country... I'm personally disgusted with both sides of this.

I disagree... I'm old enough to remember the state of things from Nixon's mess. In the end the basic tenants of the constitution and law prevailed. Both sides took to the high roads and the crooks stepped out of the leadership ranks.

I'm not seeing that prospect emerging from the current mess...

Trump isn't getting more popular although maybe his base is digging in, he's still sitting at 40%.

Looking at the polls the main thing that seems to have changed in the last 6 months is that Biden has become much less popular he's now sitting at 40% as well.
