why doesn't anybody complain about the culture, whereby the person who wants to sue goes and gets a lawyer?
believe it or not, the VAST majority of lawsuits begin when somebody calls a lawyer, not the other way around.
and, believe it or not, lawyers oftentimes do help the system. (from a capitalist perspective: they help the system by helping themselves.)
take class-action lawsuits, which this site rails against as, "Abuse of the class-action courts allows personal-injury attorneys to rake in millions of dollars in fees at the expense of the victims, who often receive trifling compensations, and the economy, which ultimately must absorb the costs of class-action cases."
it's true: most class action lawsuits have lawyers getting big fees and plantiffs getting a small amount that probably doesn't fully compensate them.
but is that so bad?
class action lawsuits are really a way to punish big companies and to discourage them from screwing the little guy.
if a CD manufacturer charges you $1 more per CD than he should, are you going to sue him? lets say you bought 200 CDs. you're out $200. are you going to hire a lawyer and take on BMG for $200? no. you're going to eat the cost. and the company knows this.
but if you and, 100,000 of your closest friends pool your money and sue the company, it might just have some effect. of course, after the lawyers' fees and the settlement offer, each person's probably not getting close to $200. but the company is stung, and hopefully, other companies realize that screwing a lot of individuals out of a small amount of money isn't as easy to do.
i'm not saying every lawyer is a saint. they're not. but they're also not the only problem. every person who thinks he's been wronged and should sue; and every jury who believes bad science and awards to the plantiff, and every judge who doesn't set aside clearly excessive damage awards is equally, if not more so at fault.

If it wasn't for litigation, corporations would be fucking us over WAY harder. Trial Lawyers are a necessary evil. Period. This stuff is designed to scare stupid people.
Cat, weren't you having problems with your health insurance recently? If it weren't for trial lawyers, health insurers would have an even greater hold on society than they already do.
Think about THAT and reflect on the meaning of this ridiculously slanted article.

Hey, i'm not against lawyers, I HAD to use them a time or two, but not to profit, just to get what was already mine, go figure.
I was sued for $10,000.00 by a guy i hit at a traffic light back in '88.
He played up all these false injuries and claimed he was partially paralyzed by the accident to which he caused by not having brake lights.
But being as i hit him from behind, I got the ticket and he got ideas to which the officer at the scene came to court with me to testify that he was a liar.
He ended up getting $500.00 and i represented myself, just told the truth and left it to the judge.
My problem is with phony lawsuits which was not the case with my health insurance problem. They fucked me and got fucked for doing so. I did profit fom that one, but it was not my idea and it is one of the reasons i don't trust a great many of them.
I do not like free money that i didn't earn. It kills my self respect.
