    Is Dave getting royalties from Duece Bigalow?

    So, has anyone heard the song parody on the Duece Bigalow trailers that is sung to the tune of Just a Gigalo?

    The voice is obviously trying to rip off Dave, and for the first few lines, whoever is singing it does a pretty good impersonation. Anyone know what the royalty on that sort of thing is or even if they have to give Dave a royalty?

    I know he didn't write the song, but they are obviously copying his version, with that vocal impersonation, so do any royalty laws apply?

    Just curious...

    Nope. The songwriters - actually, more accurately, the owners of the publishing rights - make the cash, but not Dave.

    (and in fairness, Dave's version has elements that cop to Al Jolson...Dave didn't have to provide Jolson a royaly, so it's all above board and lookin' good)

            I was gonna start a thread about this today.... I thought it was Dave singin'.... would have been nice to have a comeback hit from his old song.

              i think he only has to get permission...for covering a song i think royslties are included but for parody you dont...look at it this way how would he have even started off since when he started it was him and his drummer banging on an acordion case and neither had any money. how would he pay the royalties for such classics as my bologna and snother one rides the bus

                Dude, they have to get permission and pay royalties just to sample music arrangements for (C)Rap music songs, so you KNOW Weird Al has to pay to do entire songs replicas with just lyrical changes. Think about it.

                  i did think about it and i realized chances are he didnt have enough money to pay royalties when he started so chances are he doesn have to pay them.

                        The record company pays him an advance.

                        The record company also covers the cost of royalty payments to the owners of the publishing rights, which will be deducted from the artists own subsequent royalty payments.

                        If the artist doesn't have a record contract, the owner of the publishing rights can either issue a cease and desist order or demand payment (but in the situation of a penniless college student, they will most likely demand payment from the radio station exclusively)

                        Remember a couple of years ago when Coolio got all pissy with weird Al for the parody of Gangsta's Paradise? Remember how Weird Al defended himself simply by showing the contract granting him permission and pointing out that he bets that Coolio doesn't mind the FUCKING ROYALTY PAYMENTS COMIN IN???

                        (Al has also approached Prince and Springsteen back when to do parodies, and was refused)
