I don't understand how warner brothers can just arbitrarily decide to give three musicians on an album more royalties than the fourth. Unless they were dipping into their own pocket. For example, consider that for every unit of VH1 sold, the original agreement required that the record company split revenue with the band 50-50. Then according to a seperate agreement among the members of the band, the 50% of those revenues would be divided four ways. Suppose then that 20 years down the road, hard to imagine, but Warner Brothers decides, "hey guys, you have been good to us for all this time and we have made a ton of money on our investment, from now on we are going to split the revenue from the sale of VH1 40-60."

Then the 3 remaining members in the band do not share that windfall with the 4rth who is no longer part of the equation or a shareholder in the corporation formed by the band. Ostensibly, the 4 original members at the time of the split had a binding agreement, or a novation of their original agreement, whereby Dave would receive x amount (a sum that was not tied to the percentage received from the record company) from the sale of the albums....Is it possible that Dave's lawyers at the time did not contemplate that Warner would renegotiate the rate of royalties?

I wish I had access to the public file on the lawsuit. I can't find anything about it on the internet. Bantonelli - if you are bored one day, you should run a search on Van Halen in the Federal Courthouse out there.
