If true, what a total bitter/sweet deal for Dave. Im sure he doesnt want to see this second rate version of his band become mega successful, but then again he makes more money if they do ????

Can I really get paid for live performance royalties?
Yes! There are 2 different systems that MPA uses to monitor that various types of public performance.
1. A self-reporting system in the case of live performances, jingles, ambient music performance and on hold music.
2. The music-user reporting system is for all other performance, e.g. radio and television
In the case of live performance royalties, MPA uses a self-reporting system called the Live Performance Return (or 'LPR'). This means, that you as the MPA member will submit the information of each performance to MPA, you will then be paid according this information that you provide. You can submit these forms online at the members section of the website or alternatively submit on a paper LPR.
Paper LPR’s are due by the 31st of July and Electronic LPR’s are due the 31st of August.
If you want to claim your live performances, you will need to be a member prior to June 30th. Last year the royalties on a LPR was about 90c per song per performance, however this can change according to the distributable revenue for that financial period.

and this works worldwide...if you play music on a professional level that means giving concerts you take money and you pay covers you give the promotor a list with the songs and the composers...
depending on the size of the venue and the people who buy the tix you pay a fee to the MPA (or gema or whatever it's called in your country) then there is a system of points and everyone who was involved in the song and has rights on it gets paid...

The only way dave's going to see a penny from others playing his songs is if they release them commercially. Then the ownership issue comes into play. You can play other peoples songs live till the cows come home for free (which is why there are so many cover bands and tribute bands out there, including, once upon a time, a little band called Van Halen).
The issue of 75 years after the authors death has to do with releasing the original material by the original artist. After the statue period has passed, the material becomes public domain and can be used, issued, or released by anyone without any fees being paid. Think of songs like The Star Spangeled Banner or Dixie or books like the Bible or the works of Shakespeare - you can produce your own editions of them today and not pay the original creators a dime.

wrong...read my post above...many cover bands play "half illegal" and if you play clubs the promotors mostly pay the fees...every use commercially (live or record) has to be payed...
