California Penal Code § 422 (2001) - Punishment for (Terrorist) Threats

Any person who willfully threatens to commit a crime which will result in death or great bodily injury to another person, with the specific intent that the statement, made verbally, in writing, or by means of an electronic communication device, is to be taken as a threat, even if there is no intent of actually carrying it out, which, on its face and under the circumstances in which it is made, is so unequivocal, unconditional, immediate, and specific as to convey to the person threatened, a gravity of purpose and an immediate prospect of execution of the threat, and thereby causes that person reasonably to be in sustained fear for his or her own safety or for his or her immediate family's safety, shall be punished by imprisonment in the county jail not to exceed one year, or by imprisonment in the state prison.
For the purposes of this section, "immediate family" means any spouse, whether by marriage or not, parent, child, any person related by consanguinity or affinity within the second degree, or any other person who regularly resides in the household, or who, within the prior six months, regularly resided in the household.
"Electronic communication device" includes, but is not limited to, telephones, cellular telephones, computers, video recorders, fax machines, or pagers. "Electronic communication" has the same meaning as the term defined in Subsection 12 of Section 2510 of Title 18 of the United States Code.

That may be the santion but there is way more to it that that. I know because I tried to get a restraining order against someone who verbally threatened me and couldn't. The reason, there was no proof that this person was in any way a threat to me. No record, no priors. Good law abiding citizen who just happened to be angry with me. I left empty handed. You have to PROVE that you have a reason to be fearful of the threat... Hard to do...

Another ( a single mother like myself ) died at 38 of melanoma leaving her 13 year old daughter parentless... What a burn huh!!!
Another is battleing breast cancer and just had a mastectomy, she has 4 kids... Hell yeah!
My husband is an alcoholic (As bad if not worse than EVH except he has no money) and has basically deserted our son which wrenches my fucking heart EVERY SINGLE DAY OF MY LIFE! He probably deserves it!!!
I work 50 hours PLUS a week to support myself my son and my mother... I am such a FUCKING BITCH!!!!
Know why I hate being called fat? Because I am fucking bullimic! HAHA Isn't that a fucking RIOT!
And lastly... I recently suffered trama to my brain which has left me with permanent frontal lobe damage and involutional scars! No wonder I'm so CRAZY!!!! Fuck YEAH!!!!!

Just want to clarify a few things here.

The first threat of harm to me was that her Ex Husband was going to hunt me down and break my legs.

The next threat was for me to meet her friend in Concrete, Wa so he could beat me up.

Then it was her brother who lives in Concrete, Wa . I think he was going to hunt me down at Fabs command.

Then it was her brother and his Bad Ass Biker Friends that were going to hunt me down and break my legs at Fabs command.

The most current threat is that she will be in the Seattle area on the 26th of June to see the Padres vs. Mariners game. Fab, her brother and his Bad Ass Biker friends are going to come over and break my legs so Fab can watch.
