Poj...I know Roth is a smart enough guy, and that he likes to take care of himself...so why even HAVE a manager? Regardless of my vendetta against Sencio, when that broad this morning (the one who said she listens to Stern except on Fridays) she asked him point blank, if they fire him will he still get paid...and Dave said "Nope."...the very first thing that came to my mind was that he signed a bad contract. Tell me what the fuck else does Matt Sencio have to do but look out for Dave's best interest, and try to anticipate when Dave is getting a crooked deal? Sencio dropped the ball on this.

DLR's ATTORNEY......shame on you for not protecting your client!

A good attorney is going to break the terms of the proposed contract down so the party he or she represents can understand them. This includes having the foresight to understand their client's obligations if the contractual relationship deteriorates. Then a good attorney is going to lobby to modify the terms and conditions of the proposed contract to the advantage of his or her client. Finally, a good attorney will again explain the final draft to the client before execution so the client can understand the depth of their benefits and commitments.

Ultimately, it is the client who decides whether or not to bind themselves, not the attorney. If the attorney has explained the contract so the client understands it, her job is done. The client may ignore advice of the attorney hoping it all works out for the best. I don't see a company like CBS being to amenable to too many modifications to its offer, whatever it may have been, yet I can certainly picture Dave throwing caution to the wind in signing CBS' document even though it may have recited several objectionable terms and conditions.

I thought of this, but I hope its not the case because it makes Dave look desperate...

            Again...you are speculating...

Just from my brief encounters with Sencio...it's extremely evident that
Dave is the button pusher...and Sencio waits until the buttons are pushed...as far as the contracts go...

there's no way Dave didn't read that contract...or have it read to him...and by a lawyer...or by Sencio through a lawyer...

now if Sencio LEFT THAT OUT...he'd be fired...Dave has no patience for that...and has proved it throughout his career by canning people who were close to him for fucking up...

Trust me...either Roth heard it...and paid no attention to it...

            or just new it...

You can lay it on Sencio if you want to...

but it would be TOTAL speculation...

besides...if CBS gave Roth Carte Blanche...no offense...but THEY would be the stupidest motherfuckers on the planet...

and to think that he even had a shot at it for his first radio gig...is kinda ridiculous...

not a big-deal argument here...I just can't imagine Roth didn't know...or couldn't decide if this was a good or bad contract on his own...not like it was a minor thing here...

              And I wouldn't say desperate...

4 million dollar deal to try a new gig...

Guys like Imus and Stern before Roth didn't have a whole lot of concessions...

the difference is the Imus and Stern have great national ratings...

so they could take it to the airwaves...and essentially call CBS and/or NBC fucknuts...

and get the brass to back down...

Roth doesn't have that clout...nor ratings...

                Poj...read post #18 above...

You are right, it is speculation on my part, mostly because I believe that Dave is true to himself and would never just let himself get put over a barrel like that and 'hope for the best'...

Like I said...I really don't think his contract was ALL THAT different than Stern's or Imus'...or any other national radio jock...

I'm sure Stern and Imus had or have more concessions NOW...but...I still would be willing to bet that the both of them use their ratings..and know that as long as they are bringing in the ratings...their contracts are loosely based...

If Roth was shredding the airwaves...

trust me...he'd be telling CBS to fuck off...AND they'd be letting him...

So basically what you are saying is that Dave KNEW upfront that the possibility existed in his contract that the CBS brass could clip Dave's balls...he KNEW that they could treat him like a puppet and make him dance their dance...he accepted into his contract that a bunch of Wall Street old men could decide how Dave could run his show?

Say what you want about Dave Roth, but he is nobody's puppet.

So if he knew all this going in...why the sadness and surrender in his voice today? Why not take the high road and not even allude to it?

I forgot where I read it today but somewhere there is a post citing an article that stated Sencio and Animal have been recently banned from the CBS premesis - it implied that there was a threat of physical violence. Now I clearly don't know as much about the man as you guys but if this is true, it sounds like Sencio was going to bat for his client, literally.

when the chick asked dave if he get his pay if CBS fire him he said "nope" but he also said "they can't fire me"...I read it this way, if they fire him because of the bad ratings he gets his money...if they fire him because he doesn't follow their "rules" or theit "vision" of the format, if he refuses to follow they can kick him off without a cent...

so...if you listened to the man today, my guess is, that he says "fuck you, CBS assholes, I play your game and drive that show to hell and force you to fire me without a reason I'm guilty for...your bad and my payday"

no...he said "they could fire animal and b young but they couldn't fire me" in another part of the show...the "they can fire me" quote was referring to the question "what happens if you don't do the new format"

dave later said "I'm just trying not to lose my gig"
