There seems to be a misconception... Mike signed away his right to the use of the Van Halen name, logos and registered trademarks.
He didn't sign away his song writing & publishing rights/credits for the Van Halen catalog.
Somewhere around 96 when Best of Volume 1 release came out Mike's name mysteriously disappeared from the songwriting credits for Panama and Jump. It would be interesting if some media type would ask Ed or Al about that... the original 1984 album and the remasters credited Mike for those two songs... then out of the blue he got erased.
I'm not sure how or if the Van Halens can legally exclude Mike from the GH game from a royalties and publishing perspective for the music. Excluding his image and putting Wolfie in there is one thing but financial gain from the music is a completely different beast.
Be interesting to see the legal credits included in the game documentation. I'd bet a buck you see references to VH Music LLC, Diamond Dave Music LLC and Bassplayer Music LLC or something similar tucked away in the fine print.
If you've read the samizdat copies of Hagar's autobiography that were floating around there on the internet a year or two ago, he says the same - MA and AVH never contributed to the songwriting, but were co-credited because it was a kind of 'all-for-one, one-for-all' philosophy in the early days that carried through. That was one thing that ended up pissing Hagar off, 'cos MA was cut out, but AVH was still getting an even cut of the publishing.
It's always been a shady muz biz area. I remember reading that The STones paid Bobby Womack a million bucks in the early 80s to come into the studio and help them 'finish' songs for their Dirty Work album - he never got credit (but got the million bucks).
There were also shenanigans with royalties around the next time they tried to re-form with DLR in about 2000 - when the Diamond one discovered that VH's manager at the time had renegotiated the royalty rate for the band for all their albums, but excluded Dave. DLR said at the time that he was getting a smaller royalty rate for those albums - I think he later won the court action against VH and WB - that bass player.
What happened with Ozzy erasing Bob Daisley was a lot worse - 'cos Bob Daisley basically co-wrote all those tunes - I think he wrote lyrics and song melodies - on the first two Oz albums with Randy Rhoads.THINK LIKE THE WAVESComment

Mike has stated he was fully involved in the recording process thru Balance... it's pretty much been Ed and Al creating the scratch tracks all along but then the full band and producers have colaborated on the final cuts.

May have coincided wit the departure of Hagar and the corporate contracts with VH LLC were rewritten with WB. Both DLR and Hagar held separate royalty contracts with WB after their VH divorces.
