Hey gslinger, thanks for the informative posts. Question for you on the back catalog: I get it, and its totally obvious that the tour is all about the benjamins (like its not obvious still hates them but he's no dummy financially!), but explain further how this tour relates to the back catalog. Ultimately, isn't it the publisher and not the label that controls whether a song get used in a tv commercial, right? I don't know all the details on Dave getting screwed out of royalties, but I know he is still getting a share of the royalties based on album sales, right? And some dough from the new G. Hits CD, right?

So, Warners only stands to make money on album royalties, which presumambly should grow a bit as Van Hagar fans will buy this G. Hits and might get enlightened a bit and buy Fair Warning and VH II and learn how the mighty VH really rolled. I haven't checked their titles in Soundscan to see if sales are up...then again, are their royalties based on shipments, not on scans?

As far as publishing goes, a band of their stature has a right to refuse have their songs be used (For fear of how it will hurt their image etcc...)

Royalties are only paid on records scanned (read: SOLD). Dave's royalty issue is that several years ago, the rest of VH renegotiated and got a higher rate on the albums, whereas Dave continued to make what he always made and nobody bothered to tell him. Hence, the lawsuit, which is he should win pretty easy once all the tap dancing is done.

However, Dave's business entity should still be recieving his various royalties:

Mechanical (album related)
Performance (Radio, Gigs)
Publishing (Licensing)

He is still making a lot of money, but still a Ferrari or two shorter than the other guys. I'd sue if Michael Anthony were taking home more than me.....

the real reasons the reunion hasnt happened.

I beleive the reason a reunion hasn't happened with Dave is that wsashed up hack Eddie is a meglomaniac! He can't(and couldn't) stand Dave getting so much attention, even though Ed was hailed as the greatest guitarist of his generation. Anyone who has ever been associated with the band has been driven away at some point, by Ed's substance abuse and his all consuming ego. And Shemp Van Halen aka. Alex is just a bitter dolt who couldn't carry John Bonham's Drum Stool! I am SO FUCKING HAPPY that Diamnond Dave had the good sense to steer clear of those miscreants!
